Many individuals with disabilities rely on various means tested benefits to support themselves in the community. Many also need “fiduciary” assistance –– help making financial decisions.
There are many different “fiduciary” roles that a family member may undertake during the life of a family member with a disability, and those roles may change as the family member ages.
For many families, a Supplemental (Special) Needs Trust is a critical part of an estate plan. This type of trust is one of the most effective tools for providing financial management and protecting government benefit eligibility for individuals with disabilities. Other management arrangements like ABLE accounts may also factor into a family's planning.
In this program you will learn:
- The difference between a Guardian, Trustee, Agent and Representative Payee;
- The different types of Special (Supplemental) Needs Trusts that are used to help support individuals with disabilities in the community;
- Factors to consider when determining whether guardianship or an alternative to guardianship is the best fit for a family member;
- When an ABLE account may be an appropriate alternative to a trust;
- Basic financial eligibility rules for the Medicaid and Supplemental Security Income programs;
- Things to consider when selecting a Trustee of a Supplemental Needs Trust;
Ed Wilcenski is an attorney who concentrates his practice in the areas of guardianship, trusts, and estate planning for individuals with disabilities and their families. He is the brother of a successful and extremely capable man with a developmental disability.
